Differences between Cal/OSHA and Federal OSHA Recordkeeping

Proposition 65

Eye Flush Regulations

What is required? What are the regulations?

Direct Title 8 Wording can be found at:

http://www.dir.ca.gov/title8/5162.html
http://www.dir.ca.gov/title8/3400.html

Cal-OSHA stated that each and every chemical has a MSDS - Medical Safety Data Sheet - that explains what the medical procedure is for that particular chemical. Some do not recommend water flush. Before handling any Corrosive materials, always consult the MSDS. If the MSDS is not available, check label.

If a chemical hazard exists or there are foreseeable possible problems then eyewash as described on the Cal/OSHA web site listed above, no matter where the activity will be conducted, at the main office or out in the field, is required.

Anyone that is exposed to the corrosive materials must be able to flush the eye with continuous water flow for 15 minutes each eye. They must be able to use the flush as a single handed operation.

If there is mixing or any activity that is known to be of high hazard with a chemical, there must be an eye flush as well as a shower available that meets the specifications.
Cal/OSHA recommends that all hazardous activity happen at the office location. Protective eye wear is to be worn when administering the product.

Tree Trimmers when doing "tree trimming" activities, are not required to have an eye wash, because there are no "corrosive materials" that are being handled. They are required to wear protective eye wear.

§3382. Eye and Face Protection. States:
(a) Employees working in locations where there is a risk of receiving eye injuries such as punctures, abrasions, contusions, or burns as a result of contact with flying particles, hazardous substances, projections or injurious light rays which are inherent in the work or environment, shall be safeguarded by means of face or eye protection. Suitable screens or shields isolating the hazardous exposure may be considered adequate safeguarding for nearby employees.

The employer shall provide and ensure that employees use protection suitable for the exposure.
